Four Agencies Subpoenaed for Small Business Act Noncompliance

House Small Business Committee Chairman Sam GravesYesterday, House Small Business Committee Chairman Sam Graves sent subpoenas to the Justice, State, Treasury and Agriculture departments to testify at a hearing to be held November 1st.

A GAO report last June found that seven departments were out of compliance with requirements in the Small Business Act which requires each agency to create an Office of Small and Disadvantaged Business Utilization (OSDBU) which reports directly to that agency’s secretary or deputy secretary.  The four agencies subpoenaed maintain that they are in compliance with “the spirit of the law” and refuse to make any changes.

The subpoenas follow a letter issued to noncompliant agencies in August requesting that noncompliant agencies make necessary changes so that their OSDBU offices follow reporting requirements.

The Small Business Act helps to ensure that small businesses have equal access to government contracting opportunities.
